WHEREAS, the Board of Aldermen for the Town of Andrews, North Carolina has been petitioned by Donald Chad Higdon and Wife, Teresa Fulenwider Higdon; Sara Lynn Irby and Betty C. Resch to close an unnamed alley lying perpendicular to Sixth Street and adjacent to the properties of Petitioners; and
WHEREAS, Donald Chad Higdon and Wife, Teresa Fulenwider Higdon are the owners of real property located on Sixth Street, being Lot Nos. 3 and 4, Block “A” of the Hickerson Subdivision to the Town of Andrews; and
WHEREAS, Sara Lynn Irby is the owner of real property located on Sixth Street, being Lot Nos. 5 and 6, Block “A” of the Hickerson Subdivision to the Town of Andrews; and
WHEREAS, Betty C. Resch, is the owner of real property located on Sixth Street, being Lot Nos. 9 and a portion of Lot 10 of the Hickerson Subdivision to the Town of Andrews; and

The Board of Commissioners of Cherokee County has authorized the sale by sealed bid of the following surplus property:

The county will accept sealed bids for the property until 3 p.m., Thursday, October 12, 2006, at the office of the county manager, Cherokee County Courthouse, 75 Peachtree Street, Murphy, NC. At 3 p.m., Thursday, October 12, 2006, all bids received shall be opened in public and the amount of each bid announced and recorded. The record of bids shall be reported to the Board of Commissioners at their regular meeting on Monday, October 16, 2006.
The Board of Commissioners will determine the highest responsible bidder for the property and will award the bid by its regular meeting on November 6, 2006. Bids will remain open and subject to acceptance until the Board of Commissiones awards the bid.
Each bid must be accompanied by a bid deposit of five percent (5%) of the amount of the bid. A bid deposit may take the form of cash, a cashier’s check, or a certified check. The deposit of the bidder to whom the award is made will be held until sale of the property is closed; if that bidder refuses at any time to close the sale, the deposit will be forfeited to the county. The deposits of other bidders will be returned at the time the Board of Commissioners awards the property to the highest responsible bidder.
In order for a bid to be considered, the bidder must be current on payment of all property taxes owed to the county.
The county reserves the right to withdraw the property from sale at any time and the right to reject all bids.
